1. Subject of the contract and applicability

  1. These General Terms and Conditions (hereinafter “Terms and Conditions”) apply to all services of app-concept.com GmbH (hereinafter “app-concept.com”), which are offered for the mobile APP called “jobsnavi” for talents and companies/recruiters and can run on appropriate devices (mobile phones and computers).
  2. App-concept.com and the contractual partner agree to fulfill the services promised to each other in the contract concluded by using the jobsnavi app on the basis of these general terms and conditions and the prices published in the jobsnavi app. Our terms and conditions and prices apply exclusively. We do not recognize any terms and conditions of our contractual partners that conflict with or deviate from our General Terms and Conditions unless we have expressly agreed to their validity in writing.
  3. Our General Terms and Conditions also apply to all future transactions with contractual partners in the version valid at the time of the last contract conclusion.

2. Conclusion of contract and term

  1. For contractual partners who use jobsnavi for job advertisements (hereinafter “company”), the contract term begins after creating a company account with the subsequent publication of job advertisements. The prices for the different variants of job placement depend on the model chosen. The prices for the different models can be seen in the app. By activating the job advertisement according to the price model, the recruiter, as an authorized representative of the company, agrees to the price model and accepts it. In the event that jobsnavi offers the company/recruiter a discounted or free special offer, this offer is valid for a limited period of time for the agreed term. The company has no legal claim to special prices or changed terms. The company has no right to payment of budgets/credits deposited by jobsnavi that were created as part of special offers for the company.
  2. The activation of a company account, the booking and payment of a quota for job advertisements as well as the subsequent creation of job profiles within the framework of the booked quota implies the express acceptance of our general terms and conditions and data protection declaration.
  3. The contract term ends automatically after the booked service or quota has expired. Early termination is possible, but a refund for booked services is excluded in this case.
  4. Booked services can only be accessed within the agreed quota. Companies are granted the right to extend the contract term for a fee in accordance with Section 2.1 or to increase the quota at any time.
  5. For talents or job seekers (hereinafter referred to as “users”) who use jobsnavi to search for a job or for proactive job research, the contract term begins after creating a user account and attaching a personal profile. Activating a user account and creating a searcher profile implies the express acceptance of our general terms and conditions and data protection declaration. Our service is free for talent and job seekers. The user account remains active until the user deactivates or deletes the profile. This option is reserved to the user at any time.

3. Service description

  1. The contract obliges app-concept.com to publish job advertisements via the jobsnavi app. After the corresponding user accounts have been created and the services have been booked in accordance with Section 2.1 of the General Terms and Conditions, they will be placed online immediately, but no later than within 24 hours, provided that a sufficient budget has been set aside for the company account.
  2. The job advertisements to be published should describe the following content in as much detail as possible in order to create successful matches with talent. The company is liable for other inadmissible content with the consequences in accordance with Section 5 of the General Terms and Conditions:
    1. a) Company name, company description, welcome message, job title and job description, location of the advertised position, expected training (completed yes/no) and/or learned profession, expected professional experience, specialist skills and soft skills, place of work (remote, on site, hybrid), salary ( from-to).Language requirements,
    2. b) A job advertisement may not contain more than one job description.
    3. c) A job advertisement can be published in one of several languages.
  3. The search profile entered by the user must meet the requirements specified by the jobsnavi app and contain at least the following information:
    1. a) Pseudonym or use of the proposed alias, at least 3 specialist skills, place of residence,
    2. b) the following information is useful in order to obtain high-quality matchesCourse of study or vocational training, professional experience, highest (or desired) academic degree, training completed (yes/no), area for search, salary expectations, type of employment,If desired, the current location in the GPS can be used to find suitable job offers/matches in the area.
    3. c) A job application can only be published in one language per user.
  4. The information mentioned in sections 3.2 and 3.3 is used to create a platform for comparing job advertisements with the searcher profiles via the jobsnavi app. Jobsnavi compares the searcher profiles with existing job advertisements. If jobsnavi's analysis shows that the searcher profile and a job advertisement have a sufficient level of correspondence (matching), the mobile application presents the user with specific job offers. The user can ignore or accept these by clicking or swiping. Until the user makes a decision, he or she cannot view further job offers/matches. This feature is intentional to ensure necessary interaction.It is at our discretion to adjust the matching (currently set to 30% match).
  5. If the match is positive, jobsnavi transmits the user's profile, which is still anonymous at the time, to the company (or the recruiter) posting the respective job advertisement. Jobsnavi uses an internal messenger functionality for this purpose.
  6. The recruiter sees the user's alias profile in his app if there is a sufficiently high match. He can only see further matches if he also makes a decision by clicking or swiping.
  7. If the matching is accepted by the user and the recruiter, a chat is created. The first chat message (welcome message from the recruiter) is sent automatically.
  8. Companies (recruiters) and users can agree to the transmission of their GPS coordinates or reject them via the settings on the smartphone. If you agree to the transmission of GPS data, it can be used to contact you. If rejected, the location specified during registration will be accessed.
  9. The contractual partners are aware that content published on the Internet can be searched by search engines such as Google and others and that these search engines archive the published content.
  10. The contract entitles app-concept.com to use data from the contractual partners for trend analyzes and overviews. However, the respective results are published anonymously.
  11. Unless otherwise agreed, job advertisements with the subscription price variant will be placed for a period of 30 days. An extension in accordance with Section 2.3 General Terms and Conditions is possible at any time.
  12. With the “pay per match” variant and the “selected talents” model, the job advertisement remains online for 90 days unless it is deactivated by the recruiter beforehand.
  13. However, with the “selected talents” model, the recruiter can only see matches from talents who have previously been checked and certified for their skills.
  14. App-concept.com assumes no responsibility for the data entered into the respective job offers and searcher profiles and is in particular not obliged to retain it or return it to the contractual partner.

4. Compensation for services, cost regulations and payment agreements

  1. The remuneration for the services to be provided by app-concept.com is determined by the prices for job advertisements published by app-concept.com at www.jobsnavi.de or in the app.
  2. The remuneration covers the publication of the ad, the matching process and the provision of all technical measures that are necessary to operate the jobsnavi app.
  3. The invoice is issued immediately after booking a paid job advertisement quota and is due immediately without deductions. All prices are exclusive of the statutory VAT applicable at the time of invoicing.

5. Basics of collaboration

  1. App-concept.com reserves the right not to carry out orders placed by the contractual partner or to remove job advertisements that have already been published if the content to be published violates legal requirements, official prohibitions, third-party rights, common decency or the general terms and conditions of app-concept.com. concept.com violated. Refunds are excluded if job advertisements are removed as inadmissible.

6. intellectual property rights

  1. This contract does not contain any transfer of ownership or usage rights, licenses or other rights to the software to the users of the jobsnavi app. All rights to the software used, trademarks, titles, trademarks and copyrights and other commercial rights of app-concept.com remain unrestricted with app-concept.com.
  2. All work results and information published by app-concept.com are subject to the copyright of app-concept.com. Users of the jobsnavi app or third parties commissioned by the app-concept.com grant app-concept.com a free, simple right of use for the texts and images provided, which is limited to the term of the contract.
  3. By publishing the job advertisement or the searcher profile, the user of the jobsnavi app confirms that he has, or can freely dispose of, all usage, copyright, ancillary copyright and other rights required to publish his data.

7. Warranty, defects

  1. App-concept.com guarantees that the job offers and searcher profiles published via the jobsnavi app are implemented in accordance with the usual technical standards.
  2. Claims for defects are excluded because only data entered and released by companies and users is processed.

8. Liability

  1. App-concept.com is only liable for damage caused intentionally or through gross negligence resulting from the violation of an essential contractual obligation (obligation, the fulfillment of which enables the proper execution of the contract in the first place and on whose compliance the contractual partner regularly relies and may rely). In this case, however, liability is limited to compensation for the resulting damage as determined by the court.

9. Secrecy

  1. With the publication of job offers and searcher profiles, mutual compliance with all applicable data protection laws is agreed upon. Users of the jobsnavi app are hereby informed in accordance with the Data Protection Act that app-concept.com stores its data in machine-readable form and processes it automatically as intended.

10. final provisions

  1. The law of the Federal Republic of Germany applies to the contract and its interpretation. If the customer is a merchant within the meaning of Section 1 Paragraph 1 of the Commercial Code (HGB), a legal entity under public law or a special fund under public law, the courts at the location of app-concept.com GmbH are responsible for all disputes arising from or in connection with exclusively responsible for the relevant contractual relationship. In all other cases, app-concept.com or the customer may bring an action before any court having jurisdiction under statutory provisions
  2. Agreed services can only be accessed within the agreed quotas or contract term.
  3. App-concept.com always strives to optimize the jobsnavi app with the aim of achieving the best possible results for all contractual partners. App-concept.com reserves the right to adapt or change the jobsnavi app at its own discretion at any time.

11. Severability clause

  1. If parts of the General Terms and Conditions set out here are ineffective, the validity of the remainder will not be affected.
